Broward County Drug Court Treatment Division

The Drug Court Treatment Division is an innovative alternative to traditional incarceration for criminal offenders who have been charged with the purchase or possession of a controlled substance and/or charged with another substance abuse related offense. Our Palm Beach and Broward County drug crime defense attorneys know that the program overseen by the Drug Court helps to break the cycle of addiction and involvement with the criminal justice system by employing a variety of individualized treatment services geared at restoring the participant as a productive member of society.

Progress made by participants is actively monitored by the Drug Court Judge through regularly scheduled court hearings. As can be expected, failure to comply with the stipulations of the Drug Court Treatment Division results in the imposition of a variety of graduated sanctions.

Broward County Drug Court Treatment Division is a three-phase, multi-disciplinary approach to substance abuse treatment that encompasses both traditional and pioneering methods. The Division operates both a Pre-Trial Intervention (PTI) and Post Adjudication track. PTI clients who are first time offenders must attend treatment for a minimum of 12 months in order to be eligible for a case dismissal, something that our Palm Beach and Broward County attorneys at the Law Offices of Leifert & Leifert fight to obtain.

The three phases of treatment are outlined below.

Phase I: Substance abuse education groups are offered four times per week and frequent urinalyses are conducted for a minimum of 30 days. Acupuncture and fellowship – Alcoholics Anonymous (AA) and Narcotics Anonymous (NA) – meetings are also available to individuals participating in the program.

Phase II: Participants attend counseling two times per week for a minimum of five months (i.e., roughly 40 sessions). These counseling sessions are tremendously useful, as they help the participants identify the reasons behind their drug use and develop coping skills that might help them make more healthy choices in the future.

Phase III: Participants attend group counseling one time per week for a minimum of four months (i.e., roughly sixteen sessions). During these less-frequent sessions (as compared to those in Phase II), participants continue to discuss common issues with other participants who have found themselves in the Broward County Drug Court Treatment Division for similar reasons.

Our Palm Beach and Broward County drug crime defense attorneys know that individuals arrested for and/or charged with a drug-related offense are often times victims of the ailment of addiction, categorized as a “complex brain disease” by the National Institutes of Health (NIH). That the symptoms of the disease happen to be actions that the State of Florida have deemed to be crimes should not necessarily mean that those who act out in their addictions are criminals. Instead, those individuals should be treated with compassion. If the purpose of a correctional system (jail and/or prison) truly is to rehabilitate individuals for successful reentry into society, then the Broward County Drug Court Treatment Division should be seen as a model of efficiency, as it allows those addicted to drugs to receive rehabilitative treatment services as an alternative to jail or prison, where the root of the problem (addiction) would likely go untreated.
