Solicitation of Prostitution Charge Resolved Without Conviction Following Entrapment and Inducement Challenges
Solicitation of Prostitution / Offer to Secure for Lewd Act (Fla. Stat. §796.07(2)(f)) – Broward County, Florida
Leifert & Leifert represented a client charged in Broward County with Solicitation of Prostitution arising out of an undercover reverse prostitution operation conducted by the Broward Sheriff’s Office in Pompano Beach, Florida.
According to law enforcement reports, undercover deputies were conducting a prostitution suppression operation near North Dixie Highway when an undercover officer allegedly made contact with the client. Investigators claimed the client later agreed to pay money in exchange for sexual activity, leading to his arrest for solicitation of prostitution.
During the course of representation, the defense closely analyzed the body-worn camera evidence, investigative reports, and the circumstances surrounding the undercover encounter. The defense also researched and presented Florida case law addressing subjective entrapment, inducement, and the distinction between merely creating an opportunity for criminal conduct versus improperly persuading or inducing a defendant to commit an offense.
The case involved nuanced factual and legal issues concerning:
- who initiated the encounter,
- whether law enforcement merely created an opportunity or improperly induced criminal conduct,
- the significance of the undercover officer’s statements and conduct,
- and the application of Florida entrapment jurisprudence in reverse prostitution sting operations.
The defense specifically highlighted Florida appellate authority recognizing that “mere solicitation” or the creation of an opportunity does not automatically constitute inducement, while also emphasizing the fact-intensive nature of subjective entrapment claims and the importance of examining the totality of the undercover interaction.
Despite the client already having a prior arrest history, Leifert & Leifert successfully negotiated a favorable resolution that prevented a conviction from being entered on the client’s record. The negotiated disposition allowed the client to avoid the lasting consequences associated with a solicitation conviction and preserved future opportunities that could have otherwise been jeopardized by a permanent criminal conviction.
RESULT: Leifert & Leifert negotiated a resolution resulting in no conviction being entered against the client on the solicitation charge.
OUTCOME: The client avoided a criminal conviction, avoided adjudication, and resolved the case without a permanent conviction record despite prior contact with the criminal justice system.
