Violation of Injunction for Protection Against Domestic Violence – Contact (Fla. Stat. § 741.31(4)(a)5) – Oakland Park, Broward County, Florida

In Oakland Park, Broward County, Florida, our client was arrested for allegedly violating a domestic violence injunction under Florida Statute § 741.31(4)(a)5 after law enforcement responded to a complaint involving alleged prohibited contact with the protected party. The allegations arose during an emotionally charged domestic situation involving estranged spouses and ongoing family-related disputes.

According to the arrest reports, deputies with the Broward Sheriff’s Office responded to a residence on Oakland Forest Drive after the alleged victim claimed that the client had repeatedly contacted her by telephone throughout the day despite the existence of an active injunction prohibiting direct or indirect communication. Law enforcement alleged that while deputies were physically present inside the residence investigating the complaint, the alleged victim answered an incoming telephone call that deputies believed originated from the client. Deputies further claimed they recognized the caller’s voice and relied heavily upon the alleged victim’s statements in determining probable cause for arrest.

The allegations further involved claims that:

  • the parties had been separated for several months,
  • there had been prior domestic-related litigation,
  • and the client was allegedly attempting to discuss retrieval of personal belongings and other personal matters despite the injunction restrictions.

Based upon these allegations, the client was arrested and exposed to potentially serious criminal consequences, including:

  • incarceration,
  • probation,
  • enhanced domestic violence-related penalties,
  • additional no-contact restrictions,
  • and the lasting stigma associated with a domestic violence injunction violation allegation.

After being retained, the defense immediately undertook an extensive independent investigation into the allegations, communications between the parties, and the broader factual circumstances surrounding the incident. During the course of representation, the defense uncovered substantial inconsistencies and contradictions relating to the allegations and the alleged victim’s version of events. The defense also developed evidence materially undermining the reliability and credibility of the accusations and raising significant concerns regarding the State’s ability to establish a provable criminal violation beyond a reasonable doubt.

As part of the investigation and advocacy process, the defense presented:

  • contradictory witness testimony,
  • inconsistencies in prior statements,
  • contextual evidence relating to communications between the parties,
  • mitigation concerning the underlying domestic circumstances,
  • and additional information materially affecting the credibility and strength of the allegations.

The defense aggressively communicated these evidentiary weaknesses to the State Attorney’s Office and continued advocating against the filing of formal criminal charges. Through strategic advocacy and detailed presentation of the contradictory evidence, the defense successfully persuaded prosecutors that the case presented significant evidentiary and credibility concerns that substantially impaired the likelihood of successful prosecution.

As the matter progressed, the court additionally entered an Order Vacating Pretrial Release Conditions, formally terminating the previously imposed no-contact restrictions against the client.

RESULT: Following defense investigation, presentation of contradictory witness testimony, and strategic advocacy highlighting substantial evidentiary weaknesses, the State Attorney’s Office ultimately declined to proceed with prosecution and elected not to formally pursue the case.

OUTCOME: The client avoided formal criminal prosecution, a criminal conviction, incarceration, probation, and the severe collateral consequences associated with a domestic violence injunction violation allegation. The favorable outcome also allowed the client to avoid the long-term stigma and restrictions frequently associated with domestic violence-related criminal accusations.

This case illustrates the importance of early defense investigation, aggressive evidentiary analysis, and careful examination of witness credibility issues in injunction violation cases. By uncovering contradictions and presenting evidence undermining the allegations before formal prosecution advanced, the defense was able to secure a highly favorable outcome and prevent the case from proceeding further through the criminal justice system.
