REMEMBER: While this chart is a good general guideline, every individual reacts differently to alcohol. As our Broward County DUI defense attorneys know, the chart doesn’t take into account your individual body composition, your use of medications (which can affect the ways in which your body reacts to alcohol), your mood changes, or your personal metabolism rate. Therefore, your blood alcohol level may in fact be slightly higher or slightly lower than the chart indicates for the number of drinks you consume in a given time period.
It’s a good idea to keep in mind that your body processes alcohol at a relatively constant rate of 0.5 oz. per hour. Therefore, the faster you drink, the higher your blood alcohol level will be, as your body’s alcohol processing rate not not be able to catch up to the rate at which you’re drinking. (Note that the body’s ability to process alcohol quickly tends to diminish with age.)

In the event that you do drink and drive and you are arrested for and/or charged with DUI, remember that the time to contact an experienced DUI defense attorney is not once your trial date is nearing; you should contact us for a free consultation immediately after being released from jail after being arrested for DUI. You can legally drive for the first ten days following your arrest. Your traffic citation for DUI states that unless your license was already suspended prior to your arrest, “this citation shall serve as a temporary driver’s license and will expire on midnight on the tenth day following the date of your arrest.” The “10 day” clock begins ticking on the day of your arrest, not the day of your release from jail (which, depending on when your DUI arrest takes place, could be the following day).
Losing your license can be a serious inconvenience; it can make it impossible for you to commute to work, to go grocery shopping, to pick your child up from school, etc. You must take action within the first ten (10) days following your arrest in order to protect your ability to obtain a temporary driver’s license and exercise a challenge to the suspension of your driver’s license.
